This End User License Agreement (“EULA”) is between You and QQWIK, LLC (the “Licensor”). By downloading, using or installing this application (“Software”) via any platform You accept, and agree to be bound by, the terms of this EULA. If You do not accept the terms of this EULA, then do not check the “I accept terms” box or use this Software, as you are not entitled to do so.

License

The Licensor hereby grants You a non-exclusive, non-transferable, revocable personal licence to use this Software for your own personal use and not for commercial purposes.

Title

All rights, including title and ownership, to this Software shall remain with the Licensor unless expressly granted to You in this EULA.

Restrictions

You agree that your use of this Software shall comply with all applicable laws and regulations in the jurisdiction in which You use this Software. You may not assign, sell, distribute or otherwise make available this Software to any third parties, copy or reproduce this Software or use this Software for any purposes other than those described herein.

Privacy Policy

The Licensor may collect and use personal information from You and may use this information in an anonymised form. You accept that the Licensor may disclose information if required to do so by law.

Content

You will not submit inappropriate content to the app including, but not limited to: (i) sexually explicit materials; (ii) obscene, defamatory, libellous, slanderous, violent and/or unlawful content or profanity; (iii) content which infringes upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary right, or that is deceptive or fraudulent; (iv) content that promotes the use or sale of illegal or regulated substances, tobacco products, ammunition and/or firearms; and (v) gambling. The Licensor may deny or remove content at its discretion.

Trademarks

This EULA does not grant any permissions to use any trademarks, tradenames or other intellectual property of the Licensor.

Termination

The Licensor has the right to terminate your use of this Software at any time without notice.

Warranty Disclaimer

Unless required by applicable law, the Licensor provides its Software on an “AS IS” BASIS AND PROVIDES NO WARRANTY OR CONDITIONS, EITHER EXPRESSLY OR IMPLIED, THAT IT’S SOFTWARE WILL FIT ANY PURPOSE, WANT OR REQUIREMENT OR THAT THE SOFTWARE WILL BE FREE FROM ERROR OR DEFECT.

Limitation of Liability

YOU ACCEPT AND AGREE THAT THE LICENSOR SHALL NOT BE LIABLE TO YOU FOR ANY DAMAGES WHATSOEVER AS A RESULT OF THIS SOFTWARE OR IT’S USE OR INABILITY OF USE.

Governing Law

This EULA and any disputes relating to it will be governed by U.S law and the parties irrevocably agree and submit to the exclusive jurisdiction of the courts to settle any dispute or claim. If any provision in this EULA is held to be contrary to law, then such provision shall be amended to comply with the law while suiting, as closely as possible, the original intent of the relevant provision and the remaining provisions of this EULA will remain in full force and effect.
